Judge gives Toni McClure life without parole in starvation murder of her 5-year-old

INDIANAPOLIS — Marion County Superior Court Judge James Snyder did not hedge. On Thursday, Sept. 24, 2026, he sentenced Toni McClure to life in prison without the possibility of parole for the starvation murder of her 5-year-old daughter — a verdict the bench framed as near the outer edge of cruelty.

Jury already convicted; life without parole is the hard floor

The life sentence lands three weeks after a Marion County jury found McClure guilty of murder, criminal confinement, and battery on a person under 14. Because a jury already convicted her, today's order is punishment for proven crimes — not a provisional allegation.

According to WISH-TV and WRTV coverage of the hearing and prior investigation, IMPD responded in April 2024 to a home on Denver Drive on Indianapolis' southwest side after the child was found unresponsive. She later died of severe malnutrition.

Closet confinement and feeding failures, per investigators

Detectives concluded the girl had been forced to sleep in a small closet with a dresser blocking the exit so she could not get out. Investigators said McClure admitted she routinely put the child in the closet and did very little to make sure she was properly fed, according to local television reports citing the case file.

McClure's boyfriend, Ryan Smith, and the child's grandmother, Tammy Halsey, were also arrested. Court documents described by WISH-TV say Halsey sometimes watched the child while McClure and Smith left for errands or family events without her, and that Halsey at times used duct tape to restrain the girl and keep her from food.

Co-defendants took 20-year neglect pleas; mother got life

Smith and Halsey later pleaded guilty to neglect of a dependent and agreed to 20-year sentences. Smith's Indiana Department of Correction term began Aug. 31, 2026. Halsey was scheduled for her own sentencing hearing Thursday morning at 11 a.m., the same day McClure received life without parole.

That split — life without parole for the mother convicted of murder, versus negotiated 20-year neglect terms for the adults who pleaded — is the accountability ledger Hoosiers can actually read. One defendant faced a jury and lost everything short of death. Two others bargained down to neglect.
